These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide our services and digital content to you, how you and we may change or end our contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order. When we use the words “writing” or “written” in these terms, this includes emails.

Terms of Use

The information contained within the goods, services and digital content supplied to you is for educational, entertainment and news purposes only, and is NOT designed, construed or believed in any manner to be Trading Advice. There is no assurance that any person, corporation or individual, who uses this information will achieve favourable results. Past performance is no guarantee of future results. You hereby agree that ANY and ALL trading decisions you make are your own and reflect your own personal level of risks and trading skills. You also acknowledge and agree that you are aware of the risk parameters involved in trading and that the leveraged nature of Trading Futures, CFDs, Options, Forex Exchange and Spread Betting can cause losses greater than your account balance. You further agree to accept full, complete and sole responsibility for any and all results in your trading account. There have been no promises, guarantees or warranties suggesting that any trade will result in a profit or will not result in a loss and we make no guarantees of any future performance. It is your sole responsibility to know and define the risk before trading. You also hereby agree that you will not hold us liable or responsible in any way for any losses you incur in any trading account. We disclaim any responsibility for any adverse consequences that might arise directly or indirectly from the use of any material contained in or from any goods, services and digital content provided to you by the Company.

Distribution and/or re-transmission of any of the content provided by us in any form or by any medium is expressly prohibited. Trendsignal does not recommend or endorse specific transactions or trading methodologies or any advice concerning the value of or advisability of trading Futures, Equity CFDs, Options, Forex Exchange and Spread Betting. This service is designed to assist you and provide tools for the understanding of technical analysis of the financial markets. This is an educational web site designed solely to assist you in developing your own personal methodology if you so desire.

Internet Trading Risks

There is a risk that other circumstances may prevent you from executing orders or prevent you from accessing your 3rd party trading platform. These include, for example, system errors and outages, internet connectivity issues, failures of third parties on whom you or we are dependent (for example, internet service providers or electricity companies). Most 3rd party providers, as with Trendsignal, have business continuity measures in place to deal with some of these issues, but in some circumstances you may not be able to access your trading platform or the Trendsignal website.

Accuracy of Information

The content on this website is subject to change at any time without notice, and is provided for the sole purpose of assisting traders to make independent investment decisions. Trendsignal does not guarantee its accuracy, and will not accept liability for any loss or damage which may arise directly or indirectly from the content or your inability to access the website, for any delay in or failure of the transmission or the receipt of any instruction or notifications sent through this website.

Our Contract with you

Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. You will be provided with access to the digital content and services by way of, and not limited to, the provision of login details for the website and by you creating a subscription with the charting provider, on which the digital content is hosted.

We have the right to change the contents of our course packages from time to time, and will notify you should we decide to do so and if this will impact the services and digital content to be provided to you.

Providing the digital content and services

Access to the digital content and services (including but not limited to training material, webinars, indicators, trading tools & coaching) will usually be provided within 2 business days of your order, although this can vary due to personal circumstances. Access to the digital content and services is usually made available by the Customer Service team during an introductory phone call with you and will last as per the terms of your order.

If our supply of the services or digital content is delayed by an event outside of our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided that we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

We may need certain types of information from you in order to provide the services and digital content. If so, this will be provided in the course content information. We will contact you to ask for this information. If you do not provide the information within a reasonable time of us asking for it, or you give us incomplete or inaccurate information, we may end the contract. We will not be responsible for supplying the products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

We may have to suspend the supply of the services or digital content to deal with technical problems or to make minor technical changes, or to update the product to reflect changes in relevant laws and regulatory requirements.

We will contact you in advance to tell you if we will be suspending the provision of the services or digital content unless the problem is urgent or an emergency. You may contact us to end the contract for a product if we suspend it, or tell you that we are going to suspend it, in each case for a period of more than 30 days and we will refund you for any amount paid in advance for the services or digital content for the period after you end the contract.

If you do not pay us in accordance with the price and payment terms agreed, and you still do not make payment within 30 days of us reminding you that payment is due, we may suspend the supply of the services and digital content until you have paid us the outstanding amounts due.

Price and payment

The price of the product will be the price indicated on the order form when you placed your order. VAT will be charged where applicable.

We accept payment with all major credit and debit cards including VISA, Mastercard and American Express. When you must pay depends on what product you are buying and the terms agreed in your order. Unless you have arranged to pay by an initial deposit and subsequent instalment plan, you must pay for the products in full before you can access them.

The purchase price for the Trendsignal courses, including, but not limited to the Trendsignal Plus, Dynamic Trader, Momentum Stocks, Complete Crypto Trader and Pro Trader editions, do not include the costs for any associated 3rd party costs. The 3rd party costs include, but are not limited to; Charting Center, Ensign Software, NinjaTrader and any 3rd party data fees that are compatible with the chosen platform, which include but are not limited to Kinetick, eSignal, IQ Feed, BarChart and TraderBytes. Trendsignal Ltd is not responsible for the performance of any 3rd party provider. Please view the disclaimer for the chosen 3rd party platform to check the specific Terms and Conditions that are relevant. 

The course indicators, templates and access to Charting Center charts can be setup remotely by Trendsignal Ltd or accessed from the Charting Center website. After confirmation of purchase, information will be sent outlining the installation procedure or alternatively outlining the URL from where the software can be downloaded. The User Manual, and any other accompanying documentation that may be provided from time to time, will be sent by post or email to the given address.

Cancellation Rights

Trendsignal Courses are designed to ensure that you have the best opportunity and resources to help you succeed. Trendsignal is one of the UK’s most successful trading education providers and we pride ourselves in providing a comprehensive solution to all traders, whether experienced or just starting out.

Our courses, including, but not limited to the Trendsignal Plus, Dynamic Trader, Momentum Stocks, Complete Crypto Trader and Pro Trader editions comprise educational and trading resources provided in digital form over the internet and through our customer section of our website (Digital Content). Your Right to Cancel, referred to as a cooling off period, is for 14 days after you have paid for the service.

Cooling off Period

Please note, if you start the service within the 14-day cooling off period you agree to waive your rights to cancel the contract with Trendsignal under the Consumer Contracts Regulations. However, this does not alter your rights to cancel the contract under Trendsignal’s 14-Day Money Back Guarantee.

In order to cancel the contract within the Cooling off period, you must contact us in writing within 14 days of your purchase and before you start the service by accessing any of our digital content or downloading or streaming any of our digital content. You do not have the right to change your mind after you have started accessing any of our digital content or downloading or streaming any of our digital content, other than under the terms of Trendsignal’s Money Back Guarantee

14-Day Money Back Guarantee

The 14-Day Money Back Guarantee is only available on the Trendsignal Plus, Dynamic Trader, Momentum Stocks and Complete Crypto Trader editions, and starts on the day of purchase and supersedes the Cooling-Off period after you have started accessing any of the Digital Content.

During the first 14 days of being a Trendsignal customer, you will certainly be making good progress and be starting to learn the Trendsignal methodologies, building your confidence and skills as a trader. We are confident that you will be 100% satisfied with the course material and the progress you are making, but if you are not satisfied then you can submit a claim to have your money back*.

In order to submit a valid claim for a refund, you must contact us in writing within 14 days of your purchase. To ensure you have made an effort to engage in the Course training, in order to submit a valid refund claim, you must have watched a minimum of one online workshop (live or recording), accessed the customer area of the website, attended a minimum of 1 coaching session and evidenced at least 5 trades based on the Trendsignal methodologies (in a demo or live account).

*After any out of pocket expenses such as postage and bank charges.

Your rights to end the contract will depend on the following: -

1. If you have just changed your mind about the services purchased, then you may be able to get a refund if you are within the cooling-off period and have not yet accessed any of the digital content.
2. Exercising your right to a refund basis the terms of the 14-Day Money Back Guarantee.
3. If what you have bought is faulty or misdescribed you may have a legal right to end the contract (or a service re-performed or to get some or all of your money back).
4. If you want to end the contract because of something we have done or have told you we are going to do. For example, if we are suspending the supply of the services within the course duration due to technical defaults.
5. In all other cases, if we are not at fault then there is no right to change your mind.

If you end the contract before it is completed, you may have to pay us compensation. A contract for digital content is completed when the product is delivered, downloaded or streamed and paid for. In the case of refunds, we will refund you the price you paid for the services and digital content, by the method you used for payment.

Purchase Terms

Subscription Terms

The period for which you are subscribing will be set out in your order form and order confirmation. If you pay for your subscription by continuous credit card, your subscription will continue automatically until you cancel it. By opting to subscribe in this way, you are agreeing that your subscription will renew automatically each year at the rate then in effect (less any discount which might apply). You may opt out of this at any time after purchase.
We will notify you in advance of any change to your subscription price if that price differs to the pricing terms outlined at purchase.

Lifetime Subscriptions

Some products are available as a Lifetime subscription. Lifetime means for as long as the product is published by Trendsignal Limited. Lifetime subscriptions will come with a lifetime access to the indicators and software version available at that time. You will also receive access to the course's membership programme for an initial period as set out in your order form and order confirmation. The membership programme will include access to the member area, training workshops, upgrades and course developments. Access beyond this initial period is optional and may be available by subscribing to the course's membership programme, where monthly or annual fees may apply. These membership fees cover the unavoidable costs of developing the software and strategies as well as producing the live online coaching workshops. These current costs are outlined below.

Proprietary Property

The Trendsignal courses, product names, user manuals, documentation and other support materials are either patented, copyrighted, trademarked, constitute valuable trade secrets (whether or not they or any portion thereof may be copyrighted or patented) or are otherwise proprietary to Trendsignal.

You may use the digital content and services for your personal use or in your business or profession. Permitting unauthorised users access to the digital content and services is a violation of this license agreement.

You may not without explicit prior written permission from Trendsignal:-

• Use, modify, or transfer the digital content or services, or copy them in whole or in part, except as expressly provided herein;
• Reverse-engineer, decompile or otherwise recreate the digital content or services in whole or in part;
• Make copies of or distribute, for profit or otherwise, or authorize the copying or distribution of the digital content and services, except as herein provided;
• Make alterations to the digital content and services or merge it into any other software;
• Grant sublicenses and leases or other rights in the digital content or services to others;
• Distribute the digital content or services on either a permanent or temporary basis to others;
• Distribute the chart analysis on either a permanent or temporary basis to others.

It is agreed that the violation by you of any of the prohibitions described above shall be a material breach by you of this license agreement, and any attempt to sell, sublicense, assign, or transfer any of the rights, duties, or obligations under this agreement, except as expressly provided herein, is void.

Agreement Overview

These Terms and Conditions ("Agreement") apply to the coaching services ("Coaching Services") provided by Trendsignal Limited ("Coach") to the client ("Client") purchasing the coaching package ("Coaching Package"). By purchasing the Coaching Package, the Client agrees to the terms and conditions outlined below.

The Coach agrees to provide the Client with the Coaching Services outlined in the Coaching Package, which may include one-on-one coaching sessions, email support, and any other services as detailed in the specific coaching package description.

Coaching sessions will be scheduled at mutually agreed-upon times. It is the Client's responsibility to book sessions in advance. Sessions can be rescheduled with at least 48 hours’ notice. If the Client fails to provide at least 48 hours’ notice, the session may be forfeited and not rescheduled.

While the Coach will make every effort to help the Client achieve their desired outcomes, the Coach makes no guarantees regarding specific results. Client results depend on various factors, including effort, commitment, and external factors outside the Coach's control.

The Client acknowledges that they are responsible for their own success and decisions made during and after coaching sessions. The Client agrees to take full responsibility for implementing any recommendations or strategies discussed during the sessions.

Payment and Fees

The Client agrees to pay the full amount for the Coaching Package as outlined at the time of purchase. Payments can be made via all major credit & debit cards such as VISA, Mastercard, American Express.

All payments are due before the commencement of the first coaching session unless a payment plan has been agreed upon. The Client is responsible for ensuring timely payments. Any delays in payment may result in a delay or cancellation of the coaching sessions.

Cancellation and Refund Policy

Please note if you start the service within the 14-day cooling off period you agree to waive your rights to cancel the contract with Trendsignal under the Consumer Contracts Regulations.

In order to cancel the contract within the Cooling off period, you must contact us in writing withing 14 days of your purchase and before you start the service by attending your first 1-1 coaching session. You do not have the right to change your mind after you have attended the coaching session

Trendsignal reserves the right to cancel a session or the entire Coaching Package for any reason. In such cases, the Client will receive a full refund for any unused sessions. The coach reserves the right to terminate the coaching relationship at any time if the Client engages in behaviour that is disruptive, harmful, or not conducive to a productive coaching environment. In the event of termination, no refunds will be provided.

Confidentiality

The Coach agrees to maintain strict confidentiality regarding all information shared during the coaching sessions, including personal and business matters, unless required by law to disclose such information.

All coaching materials, content, and resources provided by Trendsignal remain the intellectual property of Trendsignal. The Client is granted a limited, non-transferable license to use the materials solely for their personal use. The Client may not reproduce, The Coach will not be liable for any damages, losses, or injury resulting from the use of the Coaching Services, including but not limited to indirect, incidental, or consequential damages. The Client agrees to hold the Coach harmless for any such damages.

Amendment

Trendsignal reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be communicated to the Client, and continued use of the Coaching Services will constitute acceptance of the updated Terms and Conditions.

Acknowledgment and Acceptance

By purchasing the Coaching Package, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
